It IS perfectly legal to copy unprotected CD's, VHS tapes, and DVD's under the Fair Use Act...the legality issue comes when the software circumvents the copy protection code *as per the DMCA*

Contrary to popular belief it is NOT legal to make backups of dvd's that are digitally copyprotected and the law is pretty clear about that.

Why do you think DVDDecrypter and 321 Studios's DVD Xcopy got shut down? It wasn't because they allowed copying of DVD's...it's because they circumvented the copyprotection.
