It absolutely does matter which platform the game is issued on. And Microsoft doesn't own the PC platform. Realistically, no one does. But Sony very obviously does own the Playstation platform. None of those games needed to be licensed by Microsoft to appear on PC because the PC platform is, almost by definition, open. In contrast, the Playstation platform is closed. Software for it is licensed by Sony, much like software for Nintendo consoles is (for the most part) licensed by Nintendo, and so on. Don't quote me on this, but I'm fairly certain that means Rockstar can not release the PS1 versions of these games as freeware without going through Sony first. Like I said, I wouldn't be surprised to see any of those games go up on the PS Store in the near future.

I'm dead certain the people at Rockstar don't even care, from what I've heard they're pretty easy-going, but you're asking about this from a legal standpoint. I'm a far cry from a real lawyer, but this is how I understand it all works.
