Curious if that breaks the rules or not. Talking about problems with a game playing on the PSP that I own for SNES. Having a strange video problem with a ROM. |

yeah, many of the sites you can get roms from clearly state that you must own the game in which you are downloading, if not, then it must be removed from the computer within 24 hours... it sounds really bad that I know that huh?...

Can I ask a question about a game I own and have an ROM for emulation on here?
Well, Super Mario World... the ROM seems to have some video issues. Wasn't sure if anyone has run into this before with this game. The cut scenes when you complete a level have something weird with the closing cut out. That wasnt really a big deal, since it is just the end.
But then in Ludwigs Castle, his fireballs do not show up and the background is half missing. I was wondering if there is a problem with the ROM or the PSP emulator or something else and if anyone else had run into anything like this. |

it's mostly the emulator. they've never been able to run the A+ nintendo titles perfectly, even on pc. at least none of the ones i've used and i've been playing emu for over 10 years
i'm sure there's a way to tweak it, but i just let it go cause well, those nintendo games are ingrained in your DNA by now.

The first is not true, you can't download it even if you own the game, it's illegal, and the second is always some made up law that these sites seem to come up with, which is totally not true. If you download a game, you've downloaded it. If you go and steal a car and take it back within 24 hours, you've still commited the crime. |

You have NO rights whatsoever to download a rom, wether you own the original or not. The game super mario world was made and sold on a cartridge. Nintendo never converted it into an image and certainly never made it available as a download. If the rom is on nintendos site with a link saying "download for free" then its free. If your getting GAME X from a dodgy website then its 100% illegal.
There is often talk about if the game is no longer sold then its ok. My mates x reg escort is no longer sold, but i cant go out and nick it lol The whole point is that the company has the rights and copyright to the game and its name. Nintendo owns the copyright and itellectual rights etc so any game or image is copyright nintendo and not for free unless stated by the copyright holder.
It is a grey area with some games, as in the early 90s there was a software company called Ocean, they could have been bought out by US Gold, who were bought out by psygnosis and then rare and then EA etc etc so although thats not acurate, it shows that the copyright of games can get lost overtime as no-one knows really who owns what.
Manic Miner was written by mathew smith in 1984 i think, although i dont think he owns the rights anymore, im pretty sure even that game is still copyright. The reason for companies to be mardy about this is simple. Even though for example, earthworm jim was a megadrive hit in the 90`s and will probably never be seen again. The rights owner still keeps the name and images if so in the future, if they were to re release an earthworm jim game, or the games were to feature on a compilation, they would still get royalties. The name dave perry and shiny entertainment springs to mind.

Well, if i remember correctly, The fair use act states that you wish to gain no profit from the game, and from what i have heard, thats the main thing you can get done for. So if you were to claim fair use, i.e, not want to gain profit, would that not give you a little leeway to be able to download roms?

No, I've seen done on youtube hundreds of times. They put a video on with copyrighted music, but put the fair use act in the description. Then it stops the video being removed.

Fair Use only applies if you legaly own the original and then ONLY if you make your OWN backup copy
Yesterday i went and got the new star wars game (yes i am a star wars fan)
first thing i did was dump the umd and then put it away on my shelf.
what i did is perfectly legal under the DMCA
Now as far as roms go, unless you have the original game cart. and the reader to pull the rom off it. any copies you have of that game are illigal and not protected under fair use.
also this applies to DVD's
but no matter how you back up the DVD it is technicly illegal since you must bypass the copy protection to do it
so no copies of a DVD/hd-dvd/blueray are legal
UMDs do not have any digital copy protection just a OFW check
so in the strictest sence of the DMCA making the backup is legal, playing it is not as you are then bypassing the protection placed on it
