My email from eBay included this:
"eBay prohibits the listing of unauthorized copies of copyrighted works. Unauthorized copies include (but are not limited to) backup, pirated, duplicated, or bootlegged copies.
Guideline: If the product you are selling is a copy of another work that you aren't authorized to copy, don't list the item. eBay prohibits the sale of items that can copy or create a backup of video games, including:
- mod chips
- softmods
- game enhancers
- boot discs
These devices are designed to bypass copyright security systems, allowing users to produce unauthorized copies of games. This is against the law and violates the rights of the copyright owner."
I had to be a dick and point out two points:
1.) CD/DVD-ROM/Burners can be used to "copy or create a backup of a video game." If you are going to follow your policy, then you can no longer allow auctions of CD/DVD-ROM/Burners, otherwise you are a hypocrite.
2.) Modchips dont infringe on copywrite protection. The moment a game is copied is when infringement takes place. Mr. Modchip over in the UK just wont a lawsuit, and had 26 indictments dropped against him because of this ruling.
I was not selling any "copies" of games. I was selling 5 LEGIT UMD movies, and 2 LEGIT UMD games, and 3 4GB memory sticks, which were FRESHLY FORMATED. There was no copywrited info on memory sticks.
